Terms of use

This is a translation for convenience. The German version is legally binding.

1. Scope and provider

These terms of use apply to the use of the "Time K" app (iOS/Android) and the associated services. The provider is Knabe GmbH, Gräserstr. 6, 52249 Eschweiler (hereinafter "we"). Contact: mail@knabe-gmbh.de.

2. Purpose of the app – Time K is an aid

Time K presents your duty roster in a readable form and offers evaluations and additional features. Time K is solely an aid for overview and personal planning.

The binding source is always the official duty roster provided by your airline as well as the legal and operational requirements applicable in each case (in particular the Flight Time Limitations / FTL). In the event of discrepancies between Time K and the official duty roster or the legal requirements, only the official duty roster and the legal requirements apply. Never rely on Time K alone for operational and legal decisions.

3. FDP/FTL calculations without warranty

Calculations and displays regarding Flight Duty Period (FDP), minimum rest periods, post-flight duty times, traffic-light/warning indicators and similar values serve solely as non-binding information. They are produced on the basis of the data read from your roster and may contain errors – for example due to incomplete or unrecognised roster formats, codes or special cases, due to changes to your actual duty, or due to input errors.

We accept no warranty for the accuracy, completeness and timeliness of these calculations. They do not replace verification against the official requirements of your airline and the applicable aviation regulations. Responsibility for compliance with all duty and flight law limits lies with you or your employer/operator.

4. External data (flight status, weather, maps)

Flight status, weather and map data partly originate from third-party providers (including AeroDataBox, NOAA, NASA GIBS, EUMETSAT) and are provided without warranty. They may be delayed, incomplete or inaccurate and do not replace official information (e.g. from air traffic control, the operator or official weather services).

5. Social features, trade marketplace and chat

The colleague comparison, trade marketplace and chat serve the voluntary coordination between users. A duty trade initiated via Time K does not become binding through Time K; only approval by your airline in accordance with its procedures is binding. The respective users are themselves responsible for the content they post or exchange. For public trade offers, your Telegram username becomes visible to other users; contact takes place outside Time K via Telegram.

6. Account, access data and user obligations

You are obliged to keep your access data secret and to provide truthful information. You use Time K only for your own legitimate purposes and do not post any unlawful or offensive content or content that infringes the rights of third parties. Import only duty rosters that you are entitled to use.

7. Beta / TestFlight

Time K is currently provided as a beta version (including via Apple TestFlight). Beta versions may contain errors, be incomplete and change at any time. Features may be added, changed or removed without prior notice. The terms of Apple additionally apply to use via TestFlight.

8. Availability

We endeavour to provide reliable operation, but do not owe any particular availability. Maintenance, malfunctions or further development may lead to temporary restrictions.

9. Liability

We are liable without limitation in cases of intent and gross negligence, as well as for injury to life, body or health. In the case of simple negligence, we are liable only for the breach of a material contractual obligation (an obligation whose fulfilment makes the proper use possible in the first place and on whose observance you regularly rely), and then limited in amount to the foreseeable damage typical for the contract. Otherwise, liability is excluded. Liability under the Produkthaftungsgesetz (German Product Liability Act) remains unaffected.

In particular, we are not liable for damage that arises because you relied on the non-binding evaluations (in particular FDP/FTL values) or on third-party data instead of checking the official requirements.

10. Changes to these terms

We may adapt these terms of use insofar as this is necessary to adapt to changed features or the legal situation. We will provide notice of material changes in an appropriate manner.

11. Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected.
